The said Resolution met a lack which remained in the effective law since November 24, 2009 when the Ukrainian Law “On Amendment of Certain Ukrainian Laws with view to Eliminate the Negative Impacts of the Financial Crisis” of June 23, 2009 No. 1533-VI entered into force. This law amended Article 13 of the Ukrainian Law “On Regime of Foreign Investments”; however no specific procedure of the state registration of foreign investment by the National bank of Ukraine was then established.
From now on, Resolution No. 762 approves the Rules of registration of the foreign investment by the National bank of Ukraine and thus specifies the tariffs and costs, list of documents required for the procedure, timings and the competence of the branches of the National bank of Ukraine to register as well as sets forth draft applications for the registration of foreign investment, notifications and changes thereto and clarifies other procedural issues.
According to the Rules, a foreign investor should within thirty calendar days from the date of foreign investment submit a set of documents for registration of foreign investment to a branch of the National bank of Ukraine.
The foreign investment is to be registered by the National bank of Ukraine within ten working days from the following day after the said set of documents is submitted. In case if the branch of the National bank of Ukraine asks the investor to submit additional documents related to the registration, the above term may be prolonged for another five working days from the following day after the additional documents are submitted.
The expenses for issuing a notification about the registration of the foreign investment amount to UAH 340,00. Costs related to amending the mentioned notification, issuance of a duplicate notification and duplicate of changes introduced therein are UAH 170,00 for each document.
